🔎 Witness Role Description

A witness is a neutral party who observes a signer execute a document and then signs their name as a witness to the event. You are not notarizing the document in this role.

As a witness, you:

Must be physically present to observe the signer.
Must not be related to the signer or a party to the document
Will sign your name on the document as a witness in-person or electronically
May be asked to take an oath affirming your impartiality and presence
Must not give legal advice or assist in completing the document
Must be able to present ID if required by the facility
Must arrive promptly and maintain professionalism throughout the appointment

⚠️ Important Requirements

You must be a currently commissioned notary
The Signature Pros will verify your commission using the official state portal (e.g., OneStop Maryland)
You are not performing a notarial act unless separately contracted to do so
You are acting as an independent contractor, not an employee
Travel beyond a reasonable radius may require pre-approval or separate agreement
Assignments may occur at hospitals, rehab centers, detention facilities, or private residences
Some assignments may require a Confidentiality or Non-Disclosure Agreement

📝 Upload W9 Form *

The W-9 form is required so that The Signature Pros can properly report payments made to you for your notarial services, as required by the IRS. Uploading your completed W-9 ensures we have your correct legal name, business name (if applicable), and taxpayer identification number on file. If you operate as a registered business (LLC, corporation, etc.), you may provide your EIN. If you are doing business as yourself (no separate business entity), you will list your own name and provide your Social Security Number (SSN) in the taxpayer identification section. This information is used solely for IRS compliance and year-end tax reporting purposes. It is stored securely and is required before any payments can be issued. Without a W-9, we are not permitted to process payment for services rendered.

Please note: you will only receive a Form 1099-NEC from us if your total payouts for the year meet or exceed the IRS minimum reporting threshold. If your total payments are below that threshold, you will not receive a 1099, but you are still required to report your income when filing your taxes.

Acceptance of Information Disclosure
By agreeing to serve as a witness, you understand and accept that:

A valid government-issued ID must be presented. If you do not wish to have your personal address stored in the electronic journal, you may instead present an acceptable ID such as a passport, which does not contain an address.
When documents require an address field, you may choose to provide either your business address or personal address at your discretion.
If you present a driver’s license or state ID, the address printed on that ID will be automatically uploaded into the notary's electronic journal.
A copy of the journal entry is provided to the signer(s) as a courtesy for their records.
